Is It Cheaper For Me to Call My C.P.A., Enrolled Agent, Regular Attorney or Accountant?
Maybe not. C.P.A.s , and E.A.s are restricted as to where they are allowed to represent people, and this greatly limits your defenses. An attorney can represent you in many arenas and each arena has different precedents, and different rules. Your case may have to be held in the Federal Court of Claims where their prior cases may be your only defense. The Fed District Courts will not have to follow those particular cases and there may be no help for you at the IRS or District Court. Your C.P.A. or E.A. may not even be aware of that particular case, and even if they are, they would not be able to use it because they can not represent people in the Federal Court of Claims, not to mention any other Federal Court.
C.P.A.s , and E.A.s can not practice in Federal Court AND THE IRS KNOWS IT. The IRS is not going to tell you or your representative if there is a better answer for you. Your representative needs to know at least as much as the IRS does and be able to appear in at least as many courts as the IRS can, if they are to fight for you.
And, do not forget, C.P.A.s , and E.A.s are not even trained in law, and therefore may not be able to, one, know if the IRS is in error, and two educate the IRS as to the errors of their ways. Unfortunately C.P.A.’s are forced to simply make deals with the IRS as opposed to fighting them for your proper treatment. Most importantly, they are not trained for the adversarial environment of IRS controversy like a lawyer is.
A regular attorney with only a normal law degree is not a tax attorney. A tax attorney has two separate law degrees. The second, known as the LL.M. in Taxation, is the most prestigious law degree there is, and many times, your only defense against the Government.
Tax law, and more particularly Federal Tax Procedure, is the most difficult, complex law there is and only a tax attorney is prepared for what is in store for you.
